FUNCTIONAL TASKS

I. POSITION AND FUNCTION

The Provincial Inspectorate is a specialized agency under the Provincial People's Committee, with the function of advising and assisting the Provincial People's Committee in state management of inspection work, handling complaints and denunciations, and preventing and combating corruption; conducting inspections, handling complaints and denunciations, and preventing and combating corruption in accordance with the provisions of law.

The Provincial Inspectorate has legal status, its own seal and account; is subject to the direction and management of the organization, staffing and work of the Provincial People's Committee, directly by the Chairman of the Provincial People's Committee; and is subject to the direction and guidance on organization and professional skills of the Government Inspectorate.

II. DUTIES AND POWERS

The Provincial Inspectorate performs its duties and powers in accordance with the provisions of law on inspection, complaints, denunciations, corruption prevention and control, and the following specific duties and powers:

1. Submit to the Provincial People's Committee:

a) Draft decisions, directives and other documents under the authority of the Provincial People's Committee on the field of inspection, settlement of complaints, denunciations, corruption prevention and control;

b) Draft 5-year and annual plans and plans; programs, projects, and measures to organize the implementation of state administrative reform tasks in the fields under the assigned state management scope;

c) Draft legal documents specifying the title standards for the Head and Deputy Head levels of organizations under the Provincial Inspectorate; Chief Inspector, Deputy Chief Inspector of the Department; Chief Inspector, Deputy Chief Inspector of the district, town, city under the province.

2. Submit to the Chairman of the Provincial People's Committee:

a) Draft decisions and individual directives on inspection, handling of complaints and denunciations, and prevention and combat of corruption under the authority of the Chairman of the Provincial People's Committee;

b) Draft annual inspection plans and other programs and plans as prescribed by law.

c) Draft decisions on the establishment, merger, separation, and dissolution of units under the Provincial Inspectorate.

3. Organize the implementation of legal documents, programs, and plans on inspection, handling of complaints and denunciations, and prevention and combat of corruption after approval; provide information, propaganda, dissemination, and education on the law on inspection, handling of complaints and denunciations, and prevention and combat of corruption.

4. Guide, inspect, and urge the Chairmen of the People's Committees of districts, towns, and provincial cities, and Directors of Departments in implementing the law on inspection, handling of complaints and denunciations, and prevention and combat of corruption.

5. Directing, guiding, inspecting the organization and professional work of administrative inspection, handling complaints and denunciations of the Inspectorate of districts, towns, provincial cities, and the Inspectorate of departments.

6. Regarding inspection:

a) Directing, guiding, inspecting, and urging the development and implementation of inspection programs and plans of the Inspectorate of districts, towns, provincial cities, and the Inspectorate of departments;

b) Inspecting the implementation of policies, laws, and tasks of the People's Committees of districts, towns, provincial cities, and specialized agencies under the People's Committees of provinces; inspecting complicated cases related to the responsibilities of many departments, People's Committees of districts, towns, provincial cities; inspecting state-owned enterprises established by the Chairman of the People's Committee of provinces and other agencies and units according to approved plans or suddenly when detecting signs of law violations;

c) Inspect other cases assigned by the Chairman of the Provincial People's Committee;

d) Monitor, inspect and urge the implementation of conclusions, recommendations and decisions on handling inspections by the Provincial Chief Inspector and the Chairman of the Provincial People's Committee;

dd) Check the accuracy and legality of inspection conclusions and post-inspection handling decisions by the Director of the Department, Chairman of the People's Committee of the district, town, provincial city, Chief Inspector of the Department, Chief Inspector of the district, town, provincial city when necessary;

e) Decide to re-inspect cases concluded by the Director of the Department but discovered signs of law violations when assigned by the Chairman of the Provincial People's Committee; decide to re-inspect cases concluded by the Chairman of the People's Committee of the district, town, provincial city, Chief Inspector of the Department, Chief Inspector of the district, town, provincial city but discovered signs of law violations;

g) Request the Director of the Department, Chairman of the People's Committee of the district, town, city under the province to inspect within the scope of management of the Department, the People's Committee of the district, town, city under the province when detecting signs of law violations; in case the Director of the Department, Chairman of the People's Committee of the district, town, city under the province does not agree, he/she has the right to issue an inspection decision and report to the Chairman of the People's Committee at the provincial level.

7. Regarding the settlement of complaints and denunciations:

a) Guide the People's Committee of the district, town, city under the province, agencies and units under the People's Committee at the provincial level to receive citizens, handle complaints and denunciations, and resolve complaints and denunciations; receive citizens at the office according to regulations;
